Welcome to PickMyLink, a service operated by PickMyAd Solution Private Limited! These Terms and Conditions ("Terms") govern your access and use of our platform, services, and payment processing. By using our services, you agree to these Terms. If you do not agree, please refrain from using our platform.

1. Definitions

1.1 "Platform" refers to PickMyLink, including its website and services, operated by PickMyAd Solution Private Limited.

1.2 "User" refers to any individual using PickMyLink, including followers and creators.

1.3 "Creator" refers to individuals providing paid services via PickMyLink.

1.4 "Follower" refers to individuals paying for services offered by Creators.

1.5 "Payment Processor" refers to Razorpay, which facilitates transactions.

2. Services Offered

PickMyLink offers a suite of applications that creators can enable or disable at any time. These apps help creators manage their online presence and provide value to their followers. The available services include:

2.1 1:1 Session Booking – Followers can book and pay for live sessions with creators.

2.2 Paid Questions – Followers can ask creators questions for a fee, with the option for creators to respond and get paid.

2.3 Affiliate Store – Creators can build a storefront showcasing their affiliate products. Followers can search, filter, and be redirected to the product purchase page via affiliate links.

2.4 Link Management (Link-in-Bio Tool) – Similar to Linktree, creators can manage multiple links on a single page, making it easier for followers to access important content.

2.5 Newsletter Subscription Collection – Creators can collect subscriber details (name, email, phone number) for newsletters and marketing purposes.

2.6 Brand Collaboration Portal – Creators can showcase their YouTube, Instagram, and other social links, enabling brands to submit collaboration inquiries through their PickMyLink public profile.

2.7 Virtual Business Card – Users can generate a digital business card with a QR code that others can scan to save contact details, eliminating the need for a physical business card.

2.8 CRM for Audience Management – A centralized system where users can collect and manage audience data from different apps, add contacts manually, and export them as CSV files for marketing or engagement purposes.

Each app functions as a plug-and-play feature that users can enable or disable at any time. When disabled, the app's functionality will no longer be visible on the user's public profile (micro-site).

PickMyLink enables creators to offer services such as:

• 1:1 Session Booking – Followers can book and pay for live sessions with creators.
• Paid Questions – Followers can ask creators questions for a fee.

3. User Responsibilities

For Creators:

• You are responsible for delivering services booked by followers.
• You agree not to engage in fraudulent activities, misrepresentation, or illegal transactions.
• You will not solicit payments outside of PickMyLink.

For Followers:

• You agree to make payments only via PickMyLink’s authorized payment gateway.
• You acknowledge that refunds are processed based on PickMyLink's refund policy.
• You will not misuse the platform for unlawful activities.

4. Payment Terms

4.1 Payments are processed through Razorpay, our third-party payment provider.

4.2 Users must provide valid payment details and consent to transaction processing.

4.3 PickMyLink does not store payment details.

4.4 Payments to creators will be released only when the booked session is completed or the paid question has been answered.

4.5 Users may be required to cover payment gateway fees as part of the transaction.

4.6 PickMyLink currently does not take any commission from payments made to creators but may introduce a commission-based model in the future.

4.7 A monthly subscription fee may apply for platform usage, which will be detailed in our pricing plans.

Refund Policy:

• 1:1 Sessions: Refunds for booked sessions are at the discretion of the creator. After the session is completed, the creator may choose to issue a full or partial refund at their discretion. If a creator cancels the session, the payment will be refunded to the follower.
• Paid Questions: If a creator does not respond to a paid question within 4 days, the payment will be automatically refunded to the follower.
• Last-minute cancellations by followers are not allowed, and no refund will be processed.
• If a creator cancels a session, the payment will be refunded to the follower.
• Any payment gateway charges for refunds and payouts will be applicable as per Razorpay’s fee structure.
• Refunds are credited back to the original payment method within 5-10 business days, subject to Razorpay’s processing timelines.
• 1:1 Sessions: If a creator fails to attend a booked session, a full refund will be issued within 4 days.
• Paid Questions: If a creator does not respond to a paid question within 4 days, the payment will be refunded to the follower.
• Refunds are credited back to the original payment method within 5-10 business days, subject to Razorpay’s processing timelines.

5. Account and Conduct

5.1 Users must create an account and maintain accurate information.

5.2 Any misuse, spamming, or unauthorized activity may result in account suspension.

5.3 Creators who repeatedly fail to attend booked sessions or do not respond to paid questions may face temporary suspension or permanent account termination at PickMyLink’s discretion.

5.4 Any engagement in nude activities, explicit content, illegal activities, hate speech, violent content, or receiving continuous complaints from customers may result in a temporary suspension or a permanent ban depending on the severity, as determined by PickMyLink’s management.

5.5 PickMyLink reserves the right to terminate accounts violating these Terms.

5.6 Immediate termination may be enforced for severe violations such as fraud, abuse, or illegal content.

5.7 Suspension with warning may be applied for minor breaches, allowing users to rectify issues before permanent termination.

5.8 No refunds will be processed for accounts terminated due to violations of these Terms.

5.9 Users must create an account and maintain accurate information.

6. Intellectual Property & Content Rights

6.1 Creators retain full ownership of the responses they provide, including answers to paid questions and content from 1:1 sessions.

6.2 By using PickMyLink, creators grant a non-exclusive, royalty-free license to PickMyLink to store, display, and use their responses for platform functionality, moderation, and dispute resolution.

6.3 PickMyLink reserves the right to use creator content for marketing and promotional activities without requiring explicit permission for each instance.

6.4 Followers are prohibited from redistributing, reselling, or sharing responses or session recordings outside of PickMyLink without the creator’s consent.

7. Data Collection & Privacy

7.1 By using PickMyLink, you consent to our Privacy Policy, which outlines how we collect and use your data.

7.2 PickMyLink collects user data for analytics, platform improvements, and performance enhancements.

7.3 PickMyLink may send marketing emails, promotional materials, and platform updates to users.

7.4 PickMyLink shares necessary user data with third-party services such as Razorpay for payment processing and analytics providers to improve user experience.

7.5 We do not sell personal data to third parties.

7.6 By using PickMyLink, you consent to our Privacy Policy, which outlines how we collect and use your data.

8. Dispute Resolution

8.1 These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of India.

8.2 Users agree to resolve disputes amicably before initiating legal proceedings.

9.1 Users agree to indemnify and hold PickMyLink, its affiliates, and employees harmless from any claims, damages, or legal actions arising from their use of the platform, including but not limited to violations of these Terms, misuse of services, or third-party claims related to user-generated content.

9.2 PickMyLink acts as a facilitator and is not liable for disputes between users.

9.3 We do not guarantee the quality of services provided by creators.

9.4 PickMyLink is not responsible for any technical failures, downtimes, or disruptions in service.

9.5 PickMyLink will not be held liable for any loss, damage, or claims resulting from the actions or inactions of users.

9.6 PickMyLink does not mediate disputes between followers and creators and holds no liability for the outcome of such disputes.

9.7 Our liability is limited to the extent permitted by law.

Force Majeure

• PickMyLink shall not be liable for any failure or delay in performing its obligations due to unforeseen events beyond its control, including but not limited to natural disasters, internet or power outages, cyberattacks, technical failures, government actions, or legal restrictions.
• If a force majeure event continues for more than 30 days, PickMyLink reserves the right to modify or terminate affected services without liability.
• Users agree to indemnify and hold PickMyLink, its affiliates, and employees harmless from any claims, damages, or legal actions arising from their use of the platform, including but not limited to violations of these Terms, misuse of services, or third-party claims related to user-generated content.
